Term of Service Individual Hosts

Effective Date: 1.7.2025

These Terms of Service ("Terms") govern your use of the Huisku platform as an individual consumer host ("you" or "Customer"). By registering and using the Huisku platform, you agree to be bound by these Terms. If you are using the platform as part of a business or professional activity, you must instead refer to the Terms for Business Property Managers & Hosts.

1. Introduction Huisku Oy ("Huisku", "we", or "us") provides an operations management platform that enables Customers to automate task workflows, coordinate services, and manage service partners. You must be at least 18 years old and legally capable of entering into binding contracts to use the platform.

2. Consumer Status and Rights You confirm you are acting as a private individual (not in a professional or business capacity). As a consumer under Finnish and EU law, you are entitled to certain statutory protections, including:

·       A 14-day right of withdrawal from this agreement, provided you have not started using the platform in a material way.

·       The right to file complaints and request resolution in accordance with Finnish consumer legislation.

3. Pricing and Payment Platform fees, if applicable, are clearly displayed before checkout. All fees include VAT unless otherwise stated. Payment can be made via credit/debit card or approved invoice.

In addition to monthly subscription fees, Huisku may offer optional add-on services or product modules for a separate one-time or recurring fee. These will be clearly presented before you confirm your purchase. By proceeding with a purchase, you agree to pay the applicable fees as described at the time of checkout.

If you receive promotional pricing, it will be valid only for the specified duration and cannot be combined with other offers.

4. Use of the Platform You may use Huisku to:

·       Coordinate cleanings and other operational services for your rental properties.

·       Manage tasks and workflows related to short-term rental operations.

·       Communicate and transact with third-party service providers available through the platform.

You are responsible for keeping your account information accurate and for maintaining the confidentiality of your login credentials. Any activity conducted through your account will be considered your responsibility.

5. Independent Service Providers Huisku is a software and marketplace provider only. The service providers you book (e.g., cleaners) are independent businesses and not employed by Huisku. Huisku is not liable for the actions, performance, or reliability of service providers. You must resolve any service-related disputes directly with the provider. Any agreement you enter into with a service provider is between you and that provider.

6. Property Damage or Theft Huisku does not provide insurance coverage for your property or belongings. If damage or theft occurs during a service booked through the platform, the matter must be resolved directly between you and the service provider. We recommend that you maintain appropriate home insurance coverage and report any suspected criminal activity to the local authorities.

6A. Limitation of Liability

To the fullest extent permitted by law, Huisku’s total liability to you for any claims arising out of or related to the use of the platform or our services shall be limited to the greater of:
(i) the total amount of platform or subscription fees paid by you to Huisku in the three (3) months preceding the event giving rise to the claim; or
(ii) €250.

This limitation shall not apply to liability resulting from Huisku’s gross negligence or willful misconduct, and it does not affect your statutory rights as a consumer under Finnish or EU law.

7. Platform Limitations Huisku strives to maintain high availability, but we do not guarantee uninterrupted access. We may suspend or limit platform features temporarily for maintenance or security reasons.

8. Cancellations and Disputes You may cancel your use of the platform at any time via your user account or by written notice. Cancellation of specific services (e.g., cleaning jobs) may be subject to service provider terms. Huisku is not responsible for refunding third-party service fees.

For complaints or disputes related to our platform, you may:

·       Contact our customer service via hello@huisku.com.

·       Submit the matter to the Finnish Consumer Disputes Board (Kuluttajariitalautakunta).

·       If you reside in the EU, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

9. Privacy and Data Use We process your personal data in accordance with our Privacy Policy. By using the platform, you consent to this processing. We only share your data with service providers to the extent necessary to perform services you have requested.

10. Prohibited Conduct You agree not to misuse the platform, including but not limited to providing false information, placing fraudulent service requests, engaging in abusive or harassing behavior, or attempting to use the platform in a way that disrupts service or harms others.

11. Intellectual Property All content and software on the Huisku platform, including but not limited to its features, user interface, workflows, and branding, are the exclusive property of Huisku Oy. You may not copy, modify, reverse-engineer, or distribute any part of the platform without our prior written permission.

12. Account Termination Huisku may suspend or terminate your access to the platform if you violate these Terms, abuse the platform, or engage in fraudulent or illegal activity. You may also delete your account at any time via your user settings or by contacting support.

13. Off-Platform Transactions and Circumvention Fee To ensure quality, transparency, and fairness for all users, you agree not to solicit, negotiate, or complete service transactions with providers introduced through the Huisku platform outside of the platform. This includes contacting service providers directly for future bookings that bypass the platform, unless expressly approved by Huisku in writing.

Engaging in off-platform transactions after an introduction via Huisku is considered a breach of these Terms and may result in the suspension or termination of your account.

In such cases, Huisku reserves the right to charge a reasonable administrative fee to compensate for lost platform revenue. This fee will be calculated based on the estimated value of the off-platform services and the applicable platform commission (capped at €500 per incident. Continued violations may result in additional sanctions, including permanent removal from the platform.

14. Subscription Policies
Monthly subscriptions automatically renew unless cancelled before the next billing cycle. You can manage or cancel your subscription through your account settings. Subscriptions are non-refundable for any prior billing periods. In certain cases, Huisku may issue partial credits at its sole discretion, but this does not constitute an obligation or guarantee.

Huisku may update subscription or add-on pricing from time to time. You will be notified at least 14 days in advance of any price change before it takes effect in your next billing cycle.

15. Updates to Terms We may update these Terms occasionally. We will notify you in advance if changes are significant. Your continued use after changes means you accept the updated Terms.

16. Governing Law These Terms are governed by the laws of Finland. If any provision is found unenforceable, the rest will remain valid.
